WILKES-BARRE, Pa. (AP) — One of two men charged in the 2013 shooting death of a disc jockey and activist outside a northeastern Pennsylvania bar has refused to take part in his own arraignment.
Twenty-eight-year-old Roberto Battle and 37-year-old David Nealy are charged in the October 2013 death of Michael Onley. He performed as DJ Mo and had rallied against gun violence.
The (Wilkes-Barre) Times Leader reports that Battle refused to raise his hand when instructed Monday in Luzerne County Court, then declined to swear an oath to tell the truth.
Prosecutors say Battle proclaims himself a “sovereign citizen,” meaning the nation’s laws don’t apply to him. A court-appointed attorney entered a not guilty plea for him. Nealy recited the oath and stood quietly as his attorney said he plans a not guilty plea.
